Terms of Service

These Terms of Service ("Terms") govern your access to and use of Traction, a software service operated by Engendr, LLC ("Traction," "we," "us," or "our"), available at gotraction.ai (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. Description of the Service

Traction is an AI-assisted content platform that helps users draft, adapt, and publish social content across supported platforms (currently including X, LinkedIn, Threads, Instagram, Facebook, and Bluesky) using patterns learned from the user's own writing. Traction is designed to amplify a user's authentic voice — it is a tool to help you write and publish more effectively, not a replacement for your judgment about what you publish.

We may add, modify, or discontinue features, supported platforms, or aspects of the Service at any time.

2. Eligibility and Accounts

You must be at least 18 years old (or the age of legal majority in your jurisdiction) and capable of forming a binding contract to use the Service. You must provide accurate registration information and keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at hello@gotraction.ai if you suspect unauthorized access.

3. Subscription, Trial, and Billing

3.1 Free Trial. New accounts may receive a 14-day free trial of the Standard plan. A valid payment card is required to start the trial. If you do not cancel before the trial ends, your card will be charged automatically for the Standard subscription.

3.2 Subscription Plans. Traction currently offers a Standard plan billed monthly or annually, as displayed at checkout. Pricing is subject to change with advance notice; changes will not apply retroactively to a period you've already paid for.

3.3 Downgrade / Lite State. If your trial or paid subscription ends without renewal, your account may be moved to a limited ("Lite") state with reduced functionality rather than being deleted, so your content and connections are preserved if you choose to resubscribe.

3.4 Billing. Subscriptions renew automatically until cancelled. You authorize us (and our payment processor) to charge your payment method on file for each renewal period. It is your responsibility to keep payment information current.

3.5 Cancellation. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period; we do not provide partial-period refunds except as required by law or as we may grant at our discretion.

3.6 Refunds. All fees are non-refundable except where required by applicable law or expressly stated otherwise at time of purchase.

3.7 Taxes. Prices do not include applicable taxes unless stated otherwise. You are responsible for any taxes associated with your purchase, other than taxes on our net income.

4. Your Content

4.1 Ownership. You retain all ownership rights in the writing samples, drafts, and other content you submit to Traction ("Your Content"). We do not claim ownership over Your Content.

4.2 License to Us. You grant Traction a limited, non-exclusive, worldwide license to access, process, store, and transmit Your Content solely as necessary to operate, provide, and improve the Service for you — including generating drafts in your voice and publishing to the platforms you connect. This license ends when you delete the relevant content or close your account, subject to Section 8 (Data Retention) of our Privacy Policy.

4.3 Voice Modeling. Traction analyzes patterns in your own writing to help generate content that sounds like you. We do not use Your Content to train models on behalf of, or for the benefit of, other customers, and we do not sell Your Content.

4.4 Your Responsibility for Published Content. You are solely responsible for reviewing and approving any content before it is published to a connected platform, and for ensuring that content complies with applicable law and with the terms of service of each platform you publish to. Traction is a drafting and publishing tool — final publication decisions and their consequences are yours.

5. AI-Generated Content Disclaimer

Traction uses artificial intelligence to generate draft content. AI-generated output may contain inaccuracies, may not perfectly reflect your intent, and should be reviewed before publishing. We do not guarantee the accuracy, originality, or fitness for any particular purpose of AI-generated content, and we are not responsible for consequences arising from content you choose to publish.

6. Connected Platforms (X, LinkedIn, Threads, Instagram, Facebook, Bluesky, and others)

6.1 When you connect a third-party social platform account, you authorize Traction to access and publish to that account via that platform's official API (in some cases through our publishing infrastructure partner, currently Zernio) on your behalf, using the permissions you grant during connection.

6.2 Your use of any connected platform remains subject to that platform's own terms of service, community guidelines, and API policies. Traction is not responsible for actions taken by a third-party platform against your account (including suspension or content removal), including as a result of content you chose to publish.

6.3 You may disconnect a platform at any time in your account settings. We are not responsible for platform outages, API changes, or rate limits imposed by third-party platforms that affect publishing.

7. Acceptable Use

You agree to use the Service in accordance with our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations may result in suspension or termination of your account.

8. Intellectual Property

The Service, including its software, design, branding, and underlying technology, is owned by Traction and protected by intellectual property laws. Except for the limited rights expressly granted to you to use the Service, no rights are transferred to you.

9. Feedback

If you submit ideas, suggestions, or feedback about the Service, you agree we may use them without obligation or compensation to you.

10. Termination

10.1 You may close your account at any time.

10.2 We may suspend or terminate your access to the Service if you violate these Terms, the Acceptable Use Policy, or applicable law, or if we reasonably believe your use of the Service poses a risk to us, other users, or third parties. Where practical, we will provide notice before termination.

10.3 Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive (e.g., Payment obligations for periods already used, Intellectual Property, Disclaimers, Limitation of Liability, Governing Law) will survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACTION AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold Traction harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, content you publish through the Service, or your violation of these Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict-of-law principles.

Agreement to Arbitrate. You and Traction agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual action in small claims court. This agreement to arbitrate is intended to be interpreted broadly.

Class Action Waiver. You and Traction agree that any arbitration or proceeding will be limited to the dispute between us individually. To the fullest extent permitted by law: (a) no arbitration or proceeding will be joined with any other; (b) there is no right or authority for any dispute to be arbitrated or resolved on a class-action basis or to utilize class-action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Opt-Out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hello@gotraction.ai with your name, account email, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will instead be resolved in the state or federal courts located in Oregon, and you consent to their exclusive jurisdiction.

Arbitration Rules. Arbitration will be conducted by a mutually agreed-upon arbitrator or arbitration provider (e.g., AAA or JAMS) under its rules then in effect, on an individual basis. Judgment on the arbitration award may be entered in any court having jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new "Last Updated" date and, for material changes, provide reasonable notice (e.g., email or in-app notice). Continued use of the Service after changes take effect constitutes acceptance.

16. General

These Terms constitute the entire agreement between you and Traction regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. You may not assign these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver of our right to do so later.
